Zero Tolerance

Discussions of things currently in the news.

Postby Lonewulf » Tue Mar 07, 2006 9:41 am

I've seen someone I knew lose his job and his entire life thanks to sexual harrasment. He tried to comfort a female coworker, and she claimed sexual harrasment. There was no investigation; he was fired on the spot. His parents didn't believe him, and threw him out of their house.

"Sexual Harrasment" is a law that pisses me off because it's gotten to the point of ridiculousness. It's so much like how a kid got suspended (or even expelled) for bringing in a plastic GI Joe gun under the "Zero Tolerance" policy.

I'd like to see a "1% Tolerance" movement.

Yep, I like the old days when the size of your chest correlated with the size of your paycheck. When wearing sleazy outfits really meant something...
In my hands I hold a candle whose flame is small to see, And if I give but one light to you my life is filled for me.
But...In your hands you hold a torch for many eyes to see, So hold it high that they may light their candlewicks from thee.

Lonewulf,

I don't know about your friends case but if he got fired as you describe, he has a good lawsuit against the company. My wife is a director of HR and she takes sexual harassment seriously. Not because it is a law but because it can destroy a workplace. She just had a case - a supervisor went with his staff to training in Miami. In the rental car from the airport the supervisor placed a call to a local and proceeded to (in front of his staff) make plans for meeting and S&M. Later, in the hotel, he called the staff up for a meeting to go over the training agenda and had the TV on showing porn. The cause one of his staff to quit after they got back and she found out why on the exit interview. She conducted a complete investigation and is firing the "gentleman" today. His action have cost her company a good system admin person and may cost them a contract. BTW - his excuse was that gay men talk a lot about sex - it is part of their culture. The employee who quit was gay and did not agree about the cultural part.

Mars bars are slightly rippled with a flat underside. They are sometimes used in English courtship rituals in which the female performs various allegorical oral acts with the chocolate bar, which is donated by the male as part payment for this spectacle.

Sexual harassment is not easy to extablish. He might be able to file for wrongful termination.

*facepalm*

I have nothing good to say on this, except that he could've very well just set the gay rights movement behind single-handedly.

(No, not really, but still. Stupid stupid man.)

You should see what my wife has to do to fire someone for cause. She has got the procedure down pat but it requires a lot of documentation and a review by a lawyer. She has only lost one appeal for unemployment and has no losses for wrongful termination.

How exactly was he comforting her? I've had men try to comfort me, and honestly for me, it's all based on mutual consent. If I don't like you, then don't touch me.

Let's just say that he wasn't the type for sexual harrassment.

Oh, that explains everything. :?

Are you implying that he was gay? Religious? Married?

Why should I have to explain anything to you? I told an anecdote, and I actually don't know a lot of details on the situation, so I can't say much on it. I wouldn't testify in court over it, for instance, and I'm mainly relying on his word.

No, that he's a nice guy, and not flirtatious at all. I couldn't see him as the type to take advantage of a woman.

Either way, I really don't want to get into this discussion, because of my lack of knowledge on it.

In today's world, a company is not going to fire you without pretty good evidence. As Bill EE alluded to, there are legality reasons. I just find your story inconclusive, therefore, I can not even attempt to make a decision on whether it was wrong or right.

How dare you! I said it, thus it must be right!

Okay, seriously, I understand your skepticism. In fact, I'm growing skeptical over the story myself (I *can* be gullible when listening to people I like). But I think it depends on the company; a smaller company is probably much more likely to make some stupid mistakes than a much larger company.

Nonetheless, you're right. Inconclusive. As I said, I wouldn't go to court with it (it would be Hearsay anyways).
