I am really a complete legal layman. It would have interested me tremendously what the legal basis for President Donald Trump's planned "seizure" or "closure" of the business of TikTok is, or on which legal bases he could appropriate a "signifacant part" of a possible buyout for the American fiscal authorities?

Anyone?

I was just reading about this and (from what I gathered) his insistence on “key money” has a number of parties scratching their heads. I’d like to hear more legal responses as well.
Is there such a thing?

I don't know whether there is any legal impediment to this, although it is certainly unconventional. I do not know whether there would be much support in congress for such a thing.

But, if successful, the situation, assuming I understand correctly, would be,

a) TikTok can sell itself to a US firm, and a significant portion of the purchase price would go to the US government.

b) TikTok can sell itself to a non-US firm, and nothing at all would go to the US government.

Sounds like something that would severely disadvantage any potential US buyer.

And the price has been lowered since Trump has threatened to close them down. Which has reduced the share going to the US government, if anything actually does.

It used to, yes. But the Donald thinks it channels personal information and spy data to Big Yellow Commie, and that is BAD for us and therefore he can SHUT IT DOWN or make a Merkin firm buy it, at a premium for th IRS, cuz, wink, wink, never forget the man in the middle.

Yeah - that probably upset him much more than any real or perceived security threat. I got a chuckle out of it.

He can't, of course, seize TikTok. But what he can do is block its use in the US - presumably by Executive Order on grounds of national security. I'm no US constitutional lawyer, but the Donald does seem to have done a lot over the last 3.5 years by Executive Order. More seriously, he's proposing to do the same to WeChat, which is how many Chinese, outside China as well as in it, communicate with each other.

Incidentally, in terms of TikTok showing more than Asian teens dancing badly, one thing it's featured quite a lot of recently is videos on systemic/structural racism. There's a nice collection on Youtube: https://uk.video.search.yahoo.com/yhs/s ... ction=view. And I personally know that that kind of thing REALLY pisses off Trump supporters.
